Welcome to ApplyKaro! Please read these Terms and Conditions ("Terms", "Terms & Conditions") carefully before using the ApplyKaro mobile application (the "App", "Service") operated by IndMon Technologies ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Definitions

  • "App" or "ApplyKaro" refers to the ApplyKaro mobile application
  • "User" or "You" refers to individuals who access or use our App
  • "We", "Us", "Our" refers to IndMon Technologies, the operator of ApplyKaro
  • "Partner" refers to verified cyber cafe operators who provide form filling services
  • "Service" refers to form filling assistance, document storage, and related features
  • "My Vault" refers to the secure document storage feature in the App
  • "Content" refers to text, images, documents, and other materials uploaded or created by users

2. Acceptance of Terms

By creating an account or using ApplyKaro, you confirm that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into a binding agreement
  • You have read, understood, and agree to these Terms & Conditions
  • You have read and agree to our Privacy Policy
  • All information you provide is accurate, current, and complete
  • You will comply with all applicable laws and regulations

3. Services Provided

3.1 Primary Services

ApplyKaro provides the following services:

  • Job Notifications: Latest government job, exam, and admission notifications
  • Form Filling Service: Professional assistance in filling government job application forms through verified partners
  • My Vault: Secure cloud storage for documents (photos, signatures, certificates, marksheets)
  • Partner Network: Connection with verified cyber cafe partners for form submission
  • Wallet: Digital wallet for transactions within the app
  • Referral Program: Earn rewards by referring friends
  • Transaction History: Track all your transactions and orders

3.2 Service Limitations

Please note that:

  • We are a technology platform connecting users with service partners
  • We do NOT guarantee selection in any government job or exam
  • We are NOT responsible for government website errors or server issues
  • We do NOT control government recruitment processes or eligibility criteria
  • Form filling services are subject to partner availability
  • Some forms may require physical presence at government offices

4. User Account

4.1 Account Registration

  • You must register using a valid mobile number
  • OTP verification is mandatory for security
  • One account per mobile number
  • You are responsible for maintaining account confidentiality
  • You must notify us immediately of any unauthorized access

4.2 Account Security

  • Enable biometric lock for enhanced security
  • Do not share your OTP or login credentials with anyone
  • Use a secure device and keep your app updated
  • Log out from shared devices

4.3 Account Termination

We reserve the right to suspend or terminate your account if:

  • You violate these Terms & Conditions
  • You engage in fraudulent activities
  • You misuse the platform or services
  • You provide false or misleading information
  • You abuse our partners or support team
  • Required by law or government authority

5. User Responsibilities

5.1 Accurate Information

You agree to:

  • Provide accurate and complete information
  • Update information promptly when it changes
  • Verify all details before form submission
  • Upload clear and legible documents
  • Ensure documents are valid and not expired

5.2 Prohibited Activities

You must NOT:

  • Use the App for any illegal purposes
  • Upload fake, forged, or tampered documents
  • Impersonate another person
  • Share your account with others
  • Attempt to hack, reverse engineer, or compromise the App
  • Use automated bots or scripts
  • Spam, harass, or abuse other users or partners
  • Upload viruses, malware, or harmful content
  • Scrape or copy content from the App
  • Circumvent security measures
  • Create multiple accounts for fraudulent purposes

6. Partner Services

6.1 Partner Verification

  • All partners are verified before onboarding
  • Partners must provide valid business documentation
  • Partners undergo background checks
  • Partners sign confidentiality agreements

6.2 Service Quality

  • Partners are trained to fill forms accurately
  • Partners follow government guidelines and deadlines
  • Partners maintain confidentiality of your information
  • Poor-performing partners are removed from the network

6.3 Partner Disputes

In case of disputes with a partner:

  • Contact our support team immediately
  • Provide order details and issue description
  • We will investigate and mediate
  • Refunds will be processed as per our Refund Policy

7. Payment Terms

7.1 Pricing

  • Service charges are displayed before payment
  • Prices may vary based on form complexity
  • We reserve the right to change prices with notice
  • All prices are in Indian Rupees (INR)
  • Prices include applicable taxes

7.2 Payment Methods

We accept payments through Razorpay:

  • Credit/Debit Cards
  • Net Banking
  • UPI
  • Wallets (PhonePe, Paytm, etc.)
  • ApplyKaro Wallet (prepaid)

7.3 Payment Security

  • All payments are processed through PCI-DSS compliant Razorpay
  • We do NOT store your card details
  • Payments are encrypted and secure
  • You will receive payment confirmation via SMS/Email

7.4 Wallet Terms

  • Minimum wallet addition: ₹10
  • Wallet balance is non-transferable to bank
  • Wallet can be used for form filling services
  • Wallet balance expires after 1 year of inactivity
  • Wallet refunds processed as per Refund Policy

8. Refund and Cancellation

  • Partial and full refund scenarios

9. My Vault - Document Storage

9.1 Storage Terms

  • Free secure cloud storage for your documents
  • Maximum file size: 5 MB per document
  • Supported formats: JPG, PNG, PDF
  • Storage available as long as account is active

9.2 Document Usage

  • Documents used ONLY for form filling when you authorize
  • Partners can view documents only for assigned orders
  • We do NOT share documents with third parties
  • You can delete documents anytime

9.3 Document Retention

  • Documents retained while account is active
  • 30-day grace period after account deletion
  • Permanent deletion after grace period
  • Backup copies removed within 90 days

10. Referral Program

10.1 Program Rules

  • Earn coins/rewards by referring friends
  • Referee must be a new user (not previously registered)
  • Referee must complete first order for reward eligibility
  • Rewards credited within 7 days of successful referral

10.2 Prohibited Practices

  • No fake or fraudulent referrals
  • No self-referrals (multiple accounts)
  • No spamming or mass messaging
  • Violators will forfeit rewards and face account suspension

11. Intellectual Property

11.1 Our Rights

All content, features, and functionality of ApplyKaro are owned by IndMon Technologies and protected by copyright, trademark, and other intellectual property laws.

This includes:

  • App design, layout, and user interface
  • ApplyKaro logo, name, and branding
  • Source code and algorithms
  • Job notifications and curated content
  • Text, graphics, and multimedia content

11.2 Your Rights

You retain ownership of content you upload (documents, personal information). However, by uploading, you grant us a limited license to:

  • Store and process your content
  • Share with partners for form filling (with your consent)
  • Use for service improvement (anonymized)

12. Disclaimer of Warranties

THE APP AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

12.1 No Guarantee of Results

  • We do NOT guarantee job selection or exam success
  • We are NOT responsible for government selection processes
  • Form filling does NOT guarantee eligibility or qualification
  • Government rules and deadlines may change without notice

12.2 Technical Limitations

  • App may experience downtime for maintenance
  • Internet connectivity required for full functionality
  • Government websites may be slow or unavailable
  • We are not liable for third-party service failures

13. Limitation of Liability

IMPORTANT: TO THE MAXIMUM EXTENT PERMITTED BY LAW, INDMON TECHNOLOGIES SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, or consequential damages
  • Loss of profits, revenue, or business opportunities
  • Loss or corruption of data
  • Government website errors or server issues
  • Form rejection due to eligibility issues
  • Delays in form submission beyond our control
  • Actions or omissions of third-party partners
  • Unauthorized access to your account due to your negligence

Maximum Liability: Our total liability shall not exceed the amount paid by you for the specific service in question.

14. Indemnification

You agree to indemnify and hold harmless IndMon Technologies, its officers, employees, and partners from any claims, damages, losses, or expenses arising from:

  • Your violation of these Terms
  • Your violation of any laws or regulations
  • Your use or misuse of the App
  • Infringement of intellectual property rights
  • False or misleading information provided by you
  • Disputes with partners or other users

15. Data Protection and Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

15.1 Data Usage Consent

By using ApplyKaro, you consent to:

  • Collection of personal and device information
  • Storage of documents in secure cloud servers
  • Sharing information with partners for service delivery
  • Use of analytics for app improvement
  • Marketing communications (with opt-out option)

16. Third-Party Services

16.1 Payment Gateway (Razorpay)

Payment processing is handled by Razorpay. Their Terms of Service apply to all transactions.

16.2 Government Websites

We provide links to official government websites for your reference. We are not responsible for their content, availability, or policies.

16.3 Analytics and Advertising

We use Firebase and Facebook SDKs for analytics and advertising. Their respective privacy policies apply.

17. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting in the App.

17.1 Notification of Changes

We will notify you of significant changes via:

  • In-app notification
  • Email to registered email address
  • SMS to registered mobile number

17.2 Acceptance of Changes

Continued use of the App after changes constitutes acceptance. If you do not agree, please discontinue use and delete your account.

18. Modifications to Service

We reserve the right to:

  • Modify or discontinue any feature temporarily or permanently
  • Change pricing with 30 days notice
  • Update app functionality and user interface
  • Remove partners from our network
  • Suspend service for maintenance

19. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law provisions.

Any disputes arising from these Terms or use of the App shall be subject to the exclusive jurisdiction of courts in India.

20. Dispute Resolution

20.1 Informal Resolution

Before filing a legal claim, please contact our support team at support@applykaro.co.in. We will attempt to resolve disputes amicably.

20.2 Arbitration

If informal resolution fails, disputes shall be settled through arbitration in accordance with the Arbitration and Conciliation Act, 1996.

20.3 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions or class arbitrations.

21. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

22. Waiver

Failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

23. Entire Agreement

These Terms, along with the Privacy Policy and Refund Policy, constitute the entire agreement between you and IndMon Technologies regarding the use of ApplyKaro.

24. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including:

  • Natural disasters (earthquakes, floods, etc.)
  • War, terrorism, or civil unrest
  • Government actions or regulations
  • Internet or telecommunications failures
  • Pandemics or public health emergencies

26. Acknowledgment

BY DOWNLOADING, INSTALLING, OR USING THE APPLYKARO MOBILE APPLICATION, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS & CONDITIONS.

IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT USE OUR APP OR SERVICES.
